Bedford Township Approves Data Center Regulations to Prevent Lawsuits

The Bedford Township Board of Supervisors unanimously approved a comprehensive ordinance on August 5, 2026, to regulate the development of future data centers. The 25-page legislation establishes specific standards for noise levels, water consumption, electrical infrastructure, environmental protections, and emergency response planning.

Township officials designed the framework to protect local farmland and property values. The board determined that a total ban on data centers would be legally untenable, with solicitor Brad Allison warning that such a move could trigger Section 1983 lawsuits under federal law. Instead, the ordinance provides a proactive regulatory structure that the board intends to update as the industry evolves.

Chairman Greg Crist advocated for the immediate implementation of these rules to ensure the township is not left without protections should developers arrive. Allison noted that the legislation is intended to get the municipality ahead of the curve, providing safeguards against the primary concerns raised by the community.
