The administration submitted written testimony from Finance Commissioner Richard Lee instead of appearing in person, citing pending litigation from homeowners as the reason for the absence.

Council members and critics slammed the implementation as dysfunctional and botched. The controversy centers on the city's publication of a tax roll containing up to 960,000 properties—including primary residences—while only 17,000 individuals were actually notified of the surcharge. Lawmakers argued the city improperly shifted the burden of proof to homeowners, forcing them to establish primary residency to avoid the tax.

While many council members support the tax's intent, they condemned the administration's refusal to testify as an attempt to dodge public accountability. A state appeals court recently allowed the city to proceed with the rollout after a temporary restraining order had briefly paused it. The city has since extended the exemption challenge deadline to September 18, and the City Council has scheduled a follow-up hearing for August 31.
