Judge Rejects xAI Motion to Dismiss Clean Air Act Lawsuit

A federal judge ruled that xAI must face a lawsuit filed by the National Association for the Advancement of Colored People over unpermitted gas turbines in Mississippi.

A federal judge in Mississippi rejected a motion by xAI and its subsidiary, MZX Tech LLC, to dismiss a lawsuit alleging violations of the Clean Air Act. The lawsuit, filed in April 2026 by the National Association for the Advancement of Colored People, claims the companies operated at least 27 gas-fired combustion turbines at the Colossus data centers and power plant in Southaven without required air permits between August and December 2025.

Judge Debra M. Brown ruled that the turbines, which can generate 495 megawatts, are not mobile sources exempt from permitting. The National Association for the Advancement of Colored People argues the facility emits nitrogen oxides and formaldehyde, potentially releasing 1,700 tons of nitrogen oxides annually. The plaintiffs are seeking pollution controls and civil penalties of up to $124,426 per day per violation.

xAI and the United States Department of Justice both sought to end the case. The Justice Department argued that the data center is critical to national security and the U.S. economy. However, the court rejected these arguments, ruling that the plaintiffs have statutory standing and that citizen-led lawsuits under the Clean Air Act are constitutional. The case will now proceed to address the alleged environmental impacts on residents in Mississippi and Tennessee.
