FTC and Local Governments Sue Hims & Hers Health

The Federal Trade Commission and local governments sued Hims & Hers Health for misleading consumers and sharing private medical data with advertisers.

The Federal Trade Commission, joined by the state of Utah and Los Angeles County, filed a lawsuit against Hims & Hers Health Inc. in the Northern District of California on July 29, 2026. The regulators allege the telehealth company misled consumers regarding privacy protections, billing practices, and subscription cancellations, violating both federal and state consumer protection laws.

According to the complaint, the company shared sensitive health data—specifically medical histories regarding weight loss and erectile dysfunction treatments—with advertising platforms Meta Platforms Inc. and Snap Inc., despite promises of discretion and privacy. The FTC also claims the company charged customers for prescriptions before they consulted with healthcare providers and created excessive barriers for users attempting to cancel subscriptions.

In response, Hims & Hers denied the allegations, calling the claims "baseless" and asserting that its Privacy Policy clarified how personal data is used. The company further argued that the lawsuit "disregards substantial evidence" from a three-year investigation. Following the announcement, shares of Hims & Hers fell as much as 16%, marking the company's largest intraday loss since May 12.
