Western Australia Fights Order to Transfer Transgender Inmate to Women's Prison

The Western Australian government, led by Premier Roger Cook, has filed a legal bid in the WA Supreme Court to block the transfer of a transgender inmate, identified as SD, from a men's prison to a women's jail. The move follows a ruling by the State Administrative Tribunal that favored the transfer of the inmate, who transitioned to female while incarcerated.

The government's Department of Justice argues that the safety of staff and prisoners must remain the priority. The legal battle has triggered a sharp political divide, particularly ahead of a byelection in Secret Harbour. One Nation leader Rod Caddies claims that gender self-identification laws jeopardize community safety and could be weaponized to place individuals in women's prisons.

Conversely, WA Greens spokesperson Jess Beckerling supports the transfer, asserting that the inmate is extremely unsafe in a men's facility. Beckerling characterized the government's legal intervention as a result of transphobia. The Department of Justice declined to comment further on the specifics of the case, citing the ongoing court proceedings.
