Supreme Court Refuses Free Speech Case Against Indiana Schools

The Supreme Court declined to hear a challenge against Noblesville Schools' policy prohibiting political flyers, including anti-abortion materials, on school walls.

The Supreme Court of the United States declined to hear a free-speech challenge brought by a former student against the Noblesville Schools district in Indiana. The lawsuit centered on a school policy that prohibited the display of anti-abortion flyers on school walls, including materials featuring the slogan Defund Planned Parenthood.

Lower courts, including a federal judge and the 7th U.S. Circuit Court of Appeals, had previously ruled that the district had the authority to regulate such content based on the Hazelwood School District v. Kuhlmeier precedent. The school district argued that its policy categorically prohibited all political content in flyers posted on its walls.

Justice Samuel Alito dissented from the decision to deny the appeal, stating the court should have clarified the distinction between government and student speech. John Bursch of the Alliance Defending Freedom, who represented the student, argued that school officials should not censor student speech that falls outside the school's curriculum.
