Senator Mark Warner Introduces AI AGENT Act for AI Accountability

Senator Mark Warner introduced the AI AGENT Act (S. 5051) on July 21, 2026, to close accountability gaps that occur when autonomous AI agents execute unauthorized transactions. The legislation defines custodial user agents and mandates that these systems maintain real-time records of all actions performed on behalf of users.

The bill directs the National Institute of Standards and Technology to develop technical standards for maintaining auditable records and verifying delegated authority. While the agency is reviewing a February 2026 draft concept paper on agent identity, its current focus remains on agents operating within single organizations rather than consumer agents that cross corporate boundaries.

In the private sector, Google has developed the Agent Payments Protocol (AP2) to create records of approved spending limits for disputed transactions. However, critics maintain that existing technical and legislative frameworks still lack a verifiable evidence chain that can function across different corporate systems.
