US Senators Draft Law to Enable AI Liability Lawsuits

U.S. senators from both parties are intensifying scrutiny of AI chatbot developers over safety risks to minors, particularly following reports of youth suicides and inappropriate interactions. During a Senate Judiciary subcommittee hearing on September 23, parents testified that their children were exploited or harmed by chatbots from companies including Google and Character.AI.

Dick Durbin and Josh Hawley are collaborating on the AI LEAD Act, which would create a federal cause of action allowing individuals and attorneys general to file product liability lawsuits against AI companies. This legislative push coincides with calls from other lawmakers, such as Senator Ed Markey, for an outright ban on minors accessing AI chatbots until companies can guarantee safety.

Industry players have responded with various measures. OpenAI OpCo, LLC announced plans to implement a new age-detection system and parental controls. Meanwhile, Meta Platforms, Inc. and Character Technologies, Inc. continue to face congressional scrutiny and legal challenges regarding their platforms' safety failures and the potential for sensual chatbot conversations with children.
