262 Pilots Sue Ryanair for Unpaid Benefits in London

A group of 262 pilots, led by former pilot Richard Phillips, filed a lawsuit against Ryanair in London’s Commercial Court seeking unpaid holiday pay and pension contributions. The claimants argue that they are legally classified as workers rather than self-employed contractors, which would entitle them to statutory protections and benefits.

This legal action names Ryanair as the primary defendant, alongside recruitment agencies Storm Global and Brookfield Aviation International and tax consultancy Scanlon Associates. The pilots rely on a previous Court of Appeal ruling involving pilot Jason Lutz, which the legal representatives argue has eliminated the airline's ability to use agency-based defenses to avoid employment obligations.

The lawsuit follows a broader trend of legal challenges to contractor status, including similar rulings in Spain and Germany and a 2021 UK Supreme Court decision regarding Uber drivers. Claims Compensation Group, the firm representing the pilots, asserts that agency-engaged pilots are workers by law and are entitled to the benefits their engagers have rarely honored.
