GOP States Challenge Abortion Shield Laws in Supreme Court

Alabama, Arkansas, and Louisiana sued California, Massachusetts, and New York to overturn shield laws that protect out-of-state abortion pill providers.

The attorneys general of Alabama, Arkansas, and Louisiana filed a challenge with the Supreme Court of the United States on Wednesday against abortion shield laws in California, Massachusetts, and New York. Steve Marshall, the Attorney General of Alabama, and his counterparts argue these protections are unconstitutional because they shield out-of-state providers who prescribe and mail abortion medication to residents in states where the procedure is illegal, thereby undermining state sovereignty and local abortion bans.

Alongside the Supreme Court challenge, the three Republican-led states filed a separate lawsuit against 30 out-of-state abortion pill providers, alleging misconduct and false advertising. This legal action seeks to declare the distribution of these drugs a public nuisance and requests unnamed damages and penalties. The conflict centers on telehealth and mail-order prescriptions, which are currently permitted under federal regulations.

Officials in the defendant states vowed to fight the lawsuits. New York Attorney General Letitia James and Governor Kathy Hochul pledged to protect reproductive care providers, while Massachusetts Attorney General Andrea Campbell stated she would vigorously defend her state's laws. James characterized the legal move as an attempt to punish doctors for providing legal health care and to impose the plaintiffs' abortion bans on New York.
