Broe Cos. Affiliates Sue Weld County Over GlobalAI Data Center
Affiliates of Broe Cos. filed a lawsuit to overturn the approval of a GlobalAI Cloud Inc. data center in Weld County, alleging regulatory manipulation.
Affiliates of the Denver-based investment group Broe Cos., including GWIP Land Co. LLC, Windsor Renewal I LLC, and GWIP LLC, have filed a lawsuit in Weld District Court against the Weld County Board of County Commissioners and GlobalAI Cloud Inc. The plaintiffs seek to overturn the September approval of a massive data center on the former Carestream Health property.
The complaint alleges that county commissioners manipulated local rules, ignored construction violations, and improperly assisted the developer. Specifically, the lawsuit claims commissioners violated Colorado’s Open Meeting Law during a site visit to Cheyenne, Wyoming, and that Commissioner Kevin Ross improperly lobbied the Western Area Power Administration to secure power for the project after the agency had initially refused GlobalAI use of its transmission lines.
Further allegations state that the county ignored three stop-work orders issued to GlobalAI for building without permits and restructured the County Building Code to prevent tradespeople from halting construction. The plaintiffs argue the project poses an existential threat to surrounding operations due to excessive noise, unquantified water demands, and energy consumption that could risk grid failure.
