Dowagiac Residents File Class-Action Lawsuit Against Hyperscale Data Inc.

Residents of Dowagiac, Michigan, are suing Hyperscale Data Inc. in a class-action lawsuit filed May 26 in the U.S. District Court. The litigation alleges that noise from the company's data center constitutes a common-law nuisance that invades neighboring properties, potentially affecting approximately 1,300 homes within one mile of the facility.

At a community forum on June 30 held at the Dowagiac Public Library, residents described the noise as a constant vibration or whining. Some participants raised further concerns regarding security harassment and water contamination, though attorneys from Liddle Sheets, P.C. stated the current legal focus remains on property rights and noise pollution.

Despite the ongoing lawsuit, Hyperscale Data Inc. recently announced plans to expand its facility. The Dowagiac City Council is scheduled to discuss these expansion plans on July 13, while the company has until July 24 to formally respond to the legal complaint.
