The artificial intelligence company xAI filed a lawsuit in U.S. District Court to block the enforcement of Colorado's Senate Bill 24-205. Scheduled to take effect on June 30, 2026, the law requires developers of high-risk AI systems—specifically those used in healthcare, education, housing, employment, and financial services—to implement disclosure and risk-mitigation measures to prevent algorithmic discrimination.

xAI argues the legislation violates the First Amendment by compelling speech on public issues and restricting how developers design their systems. The company asserts that the law would force its Grok chatbot to adopt state-enforced views on diversity and discrimination, abandoning its pursuit of objective truth in favor of a state orthodoxy.

Beyond the constitutional challenge, xAI claims that a patchwork of varying state-level regulations hampers innovation and undermines U.S. national security and global AI leadership. The company advocates for a streamlined federal framework to replace fragmented state laws. The legal action comes as Colorado officials, including Governor Jared Polis and Attorney General Philip J. Weiser, defend the necessity of the law to prevent biased algorithmic outcomes in critical services.
