Jamaican National Avoids UK Deportation After Legal Challenge

Jamaican national Mark Nelson avoided deportation to Jamaica after a successful legal challenge halted his scheduled removal on August 7. Nelson, who has lived in the United Kingdom since 2000 and has a British partner and five British children, was detained last month following a previous 2022 deportation target after serving a four-year prison sentence for drug possession, electricity theft, and racially aggravated harassment.

Lawyers from MTC Solicitors provided pro bono representation after a Guardian report highlighted the case, filing an 11th-hour application for judicial review. The Home Office subsequently cancelled Nelson's flight, and he was granted bail this week. His legal team has since lodged an appeal in the first-tier tribunal and referred him to the national referral mechanism as a potential victim of modern slavery.

Naga Kandiah of MTC Solicitors argued that a prison sentence should not become a life sentence by another name, noting that Nelson had already served his sentence for offenses committed in 2017. The Home Office maintains that all foreign national offenders who receive a prison sentence in the UK are referred for deportation at the earliest opportunity.
