KKR to Pay $250 Million to Settle DOJ Antitrust Lawsuit
KKR & Co. agreed to pay a record $250 million penalty to resolve Department of Justice allegations that it withheld documents during merger reviews.
KKR & Co. Inc. agreed to pay $250 million to resolve a civil antitrust lawsuit filed by the United States Department of Justice. The settlement addresses allegations that the private equity firm intentionally withheld documents from government-required merger reviews for at least 16 deals valued at more than $24.7 billion.
The penalty is the largest ever imposed for filing violations under the Hart-Scott-Rodino Act, surpassing the previous record of $12 million paid by Edwards Lifesciences Corp. The agreement covers all KKR entities for deals filed before 2025.
The lawsuit began during the final week of the Biden Administration as part of a broader effort to increase antitrust scrutiny of the private equity sector. The legal action continued through the transition into the Trump Administration before reaching this resolution.
