Judge Denies xAI Request to Block California AI Law

A U.S. District Judge in Los Angeles denied a request by xAI, an artificial intelligence company founded by Elon Musk, to temporarily block a California law requiring data transparency for generative AI. In a ruling issued March 5, 2026, Judge Jesus Bernal rejected the bid for a preliminary injunction, stating the company failed to demonstrate that the law violates its free-speech rights or is unconstitutional.

The law, signed by Governor Gavin Newsom in September 2024 and effective since January 1, mandates that generative AI companies publicly post summaries of the datasets used to train their models. xAI filed a lawsuit against the state in December, arguing that the disclosure of proprietary methods and trade secrets harms innovation and violates the First Amendment.

While the broader legal challenge continues, the ruling ensures the transparency mandate remains active. The California Department of Justice characterized the decision as a key victory in its defense of the legislation.
