Albertsons and Kroger Begin Trial Over Failed Merger
Albertsons Cos. and Kroger Co. start a two-week trial in Delaware to determine who is responsible for the collapse of their $24.6 billion merger.
The Albertsons Cos. and Kroger Co. will begin a two-week trial in Delaware Chancery Court on Monday to determine which company bears responsibility for the collapse of their proposed $24.6 billion merger. The deal aimed to create the largest grocery chain in the United States by combining more than 4,000 stores.
A federal court blocked the merger in December 2024 following a challenge by the Federal Trade Commission. The agency argued that the combined entity would possess excessive market power, leading to the eventual failure of the agreement.
Former chief executive officers from both companies are scheduled to testify during the proceedings. The outcome of this legal battle may establish significant precedents for other large-scale corporate mergers currently facing antitrust scrutiny from federal regulators.
