Virginia has implemented a new energy consumption tax and stricter environmental regulations to manage the growth of the world's largest concentration of data centers. Abigail Spanberger and the General Assembly approved the consumption tax, which is expected to generate $600 million annually, alongside new controls for water use in scarce areas, noise levels, and backup generator emissions. These measures respond to mounting community opposition regarding the industry's heavy demands on energy and water resources.

While introducing these new costs, Governor Spanberger pushed to preserve a 2008 sales and use tax exemption through 2035. This exemption costs the state approximately $1.9 billion annually but has been a primary driver of the industry's growth in Northern Virginia and Loudoun County, where the industry provides over $100 million in annual revenue.

The Data Center Coalition has criticized the new consumption tax, arguing it damages the state's reputation as a reliable business partner and may deter future investment. In response to the ongoing debate over industry impacts and revenue, lawmakers have commissioned a legislative work group to study the potential phase-out of the primary sales tax exemption, with a report due in November.
