Tesla Faces Trial Over Alleged Racial Discrimination in California

A bench trial began on September 21 in Oakland to determine if Tesla, Inc. allowed systemic racial discrimination and harassment against Black workers at its Fremont assembly plant. The lawsuit, filed in February 2022 by the California Civil Rights Department following a three-year investigation, alleges that over 6,000 workers were subjected to racial slurs and white supremacist graffiti. The state further claims the plant was racially segregated, with Black employees relegated to the lowest-paying roles and denied promotion opportunities.

Tesla, Inc. has rejected the allegations as misguided, asserting that it does not tolerate discrimination and has terminated employees found guilty of misconduct. During opening statements, Tesla lawyer Tyree Jones argued that the state is attacking the way many Black people greet each other and that the company is a victim of unfair treatment. Conversely, state lawyer Brett Watson presented evidence of employee abuse, arguing that hundreds of complaints prove the experiences were not isolated.

Judge Peter Borkon is presiding over the trial, which is scheduled to run until October 30. This case is the first government-led lawsuit on behalf of multiple workers to reach trial, bypassing the company's employee arbitration agreements. Because California law does not cap damages for workplace discrimination, Tesla, Inc. faces potential liabilities totaling millions of dollars.
