Court of Appeal of Nigeria Validates INEC 2027 Election Guidelines

The Court of Appeal of Nigeria overturned a lower court ruling and validated the Independent National Electoral Commission's guidelines and timetable for the 2027 general elections.

The Court of Appeal of Nigeria in Abuja validated the Independent National Electoral Commission's (INEC) guidelines and revised timetable for the 2027 general elections on Thursday, July 16, 2026. A three-member panel unanimously set aside a May 20 judgment from the Federal High Court in Abuja, which had previously nullified the guidelines by claiming they violated the Electoral Act, 2026.

The Federal High Court had invalidated specific INEC deadlines regarding political party primaries, the submission of membership databases, and candidate nominations. However, the appellate court ruled that the Youth Party, which initiated the lawsuit, lacked the legal standing to bring the case and failed to show how the guidelines impacted its operations.

Lead counsel Dr. Alex Izinyon argued that the lower court's ruling was based on a hypothetical suit and denied INEC a fair hearing. The appellate court concluded that INEC acted within its statutory powers and that the revised timetable constitutes subsidiary legislation with the force of law.
