West Virginia Voters Approve Non-Citizen Voting Ban

West Virginia voters approved a constitutional amendment banning non-citizen voting and re-elected Senator Shelley Moore Capito during November 4 elections.

Voters in West Virginia approved Amendment 1 on November 4, 2026, adding a prohibition against non-citizen voting to the state constitution. Unofficial results showed approximately 78% support, with yes votes leading by more than 100,000. The amendment specifies that only U.S. citizens who are residents of the state are entitled to vote, a move intended to prevent future legislatures or cities from altering registration rules despite such voting already being illegal under state and federal law.

West Virginia voters also returned Republican Senator Shelley Moore Capito to a third term and re-elected incumbent Riley Moore in the 2nd Congressional District. The constitutional amendment was placed on the ballot after the West Virginia Legislature unanimously passed Senate Joint Resolution 9. A U.S. Department of Justice election monitor was stationed in Charleston during the proceedings but remained outside polling precincts.

Simultaneously, voters in other states decided on local measures. In Colorado, preliminary results in Pitkin County indicated support for the Healthy Community Fund and water treatment facility debt in Aspen. In Michigan, voters in Oakland, Wayne, and Macomb Counties weighed bond proposals for public safety infrastructure in Bloomfield Township, school renovations in Dearborn, and road reconstruction in Pontiac.
