Harmony Township Cancels Vote on Data Center Moratorium

The Harmony Township Board of Supervisors canceled a special meeting to vote on a development moratorium following legal challenges over public notice requirements.

The Harmony Township Board of Supervisors canceled a special meeting scheduled for October 22, 2026, which was intended to determine whether to implement a moratorium on large developments, including data centers. The cancellation followed a request from attorney Joel Fremstad, who represents landowners Tom and Jill Roden. Fremstad argued that the township failed to meet public notice requirements and potentially violated state open meeting laws, prompting him to seek a formal opinion from the Attorney General's Office.

The procedural dispute coincides with conflict-of-interest allegations involving Tom Roden, a former township board chair. Board Clerk Jon Zuther stated that Roden failed to disclose a land purchase agreement with Geronimo Power while voting on data center zoning ordinances in July. However, Fremstad contends that written records confirm the disclosure was made to the Zoning Administrator and former board attorney Sarah Wear.

Geronimo Power, which is seeking to develop a data center and battery storage project in the area, stated that it hopes the cancellation will facilitate more productive dialogue between officials and residents.
