Court Orders ADC Secretary to Pay N100 Million Fine

Nkemakolam Ukandu must pay N100 million to two judges after a Federal High Court struck out his lawsuit for lack of diligent prosecution.

A Federal High Court in Abuja ordered Nkemakolam Ukandu, the National Welfare Secretary of the African Democratic Congress (ADC), to pay N100 million in damages to two members of the judiciary. Justice Salim Ibrahim awarded N50 million each to Chief Judge John Tsoho and Justice Peter Lifu, requiring the total sum to be paid within 14 days.

The ruling followed the court's decision to strike out a lawsuit filed by Ukandu against the National Judicial Council, Tsoho, and Lifu. Ukandu had alleged judicial bias, corruption, and disobedience of court orders, seeking to compel the National Judicial Council to investigate the judges. The legal dispute stemmed from an internal leadership crisis within the ADC involving members Nafiu-Bala Gombe and David Mark.

Justice Ibrahim dismissed the case for lack of diligent prosecution, noting that neither Ukandu nor his legal counsel appeared for hearings despite receiving notices and a prior warning issued on June 30. The fine was awarded following an oral application by J.U.K. Igwe, a Senior Advocate of Nigeria representing the defendants.
