Delhi Court Orders Probe Into Sonia Gandhi Voter Roll Allegations

A Delhi sessions court has set aside a magistrate's order that previously refused to investigate allegations that Congress leader Sonia Gandhi was unlawfully included in electoral rolls before acquiring Indian citizenship. Special Judge Vishal Gogne ruled that the Additional Chief Judicial Magistrate's September 11, 2025, order was non-speaking and perverse, noting it failed to determine if a cognizable offense of cheating or forgery had occurred.

The complaint, filed by advocate Vikas Tripathi, alleges that Gandhi's name appeared in the New Delhi Parliamentary Constituency roll in 1980 while she was an Italian citizen. The filing claims her name was deleted in 1982 and re-entered in 1983, all before she officially obtained Indian citizenship on April 30, 1983.

While the magistrate had originally dismissed the claims as bald assertions based on unverified photocopies, Judge Gogne emphasized that the sanctity of electoral rolls merits a reasoned investigation. He found the original dismissal suffered from manifest errors in law and ignored procedural requirements of the Bharatiya Nagarik Suraksha Sanhita. The matter has been remanded to the magisterial court for a fresh hearing and a police status report, with further proceedings scheduled for September 29.
