Democratic Governor Josh Shapiro and Republican challenger Stacy Garrity are campaigning with sharply contrasting visions for cannabis policy in Pennsylvania. Shapiro advocates for the legalization of adult-use marijuana, proposing a state-run program managed by the Department of Agriculture. His plan includes a 26% tax on sales to generate an estimated $200 million annually for healthcare and education, with $10 million earmarked for restorative justice and $25 million for small businesses. He also supports expunging the criminal records of nonviolent marijuana offenders.
State Treasurer Stacy Garrity opposes recreational legalization and has vowed to veto any such legislation. She characterizes marijuana as an addictive substance with negative public health effects and describes Shapiro's tax proposal as a desperate attempt to fill the state's budget deficit.
While Shapiro expanded the state's medical marijuana program in 2023, Garrity has criticized the Pennsylvania Department of Health for regulatory inconsistencies and a lack of transparency in its oversight. The candidates also differ on intoxicating hemp-derived products; the Shapiro administration maintains that current laws prohibit THC in food and beverages, while Garrity has not provided a public position on hemp policy.
