Louisiana Governor Jeff Landry Rebrands Data Centers as Digital Factories

Governor Jeff Landry introduced stricter tax exemption requirements for data centers and rebranded the facilities as digital factories to address public concerns over AI buildouts.

Governor Jeff Landry announced new requirements for data center sales tax exemptions and declared that the state will now refer to these facilities as digital factories. The policy shift follows bipartisan voter pushback against AI data center buildouts during the midterm elections and occurs as other states, such as Texas, have issued moratoriums on development.

To qualify for tax breaks, developers must now provide a detailed attestation proving they have established partnerships with universities, generated sustainable local revenue, and made long-term commitments to local schools and nonprofits. This follows a June executive order requiring developers to pay for their own power to prevent residential electric bill increases.

The rebranding and regulatory tightening come as Louisiana Senate candidate Jamie Davis campaigns on regulating AI. Public Service Commissioner JP Coussan criticized data center developers for failing to communicate the benefits of their projects to the public, suggesting they are now playing catch up.
