UK Drivers Struggle With Highway Code Rule H2 Updates

Widespread confusion persists among UK motorists and pedestrians regarding Rule H2 of the Highway Code. The rule stipulates that drivers should give way to pedestrians crossing or waiting to cross a road when turning into or out of a junction. This ambiguity follows a 2022 update that expanded the requirement to include pedestrians waiting to cross, rather than only those already in the road.

Motoring experts note that because the code uses the word 'should' instead of 'must,' failure to comply is not an automatic fixed penalty offense. However, such failures can be used as evidence of liability or dangerous driving in court after a collision. Pedestrians on social media have reported that many drivers remain unaware of the rule, leading some to let vehicles pass to avoid unpredictable behavior.

Dan Briggs, CEO of Motorfinity, argued that the rule requires clearer criteria to protect vulnerable road users. Other experts recommend that drivers make decisive movements and that pedestrians maintain eye contact to confirm a vehicle is slowing. Separately, The Automobile Association found that more than half of drivers struggle to understand various parts of the Highway Code and essential road signs, such as Clearway and No Entry signs.
