TRAI Recommends Mandatory Licensing for Live TV Streaming Apps

The Telecom Regulatory Authority of India proposes a government authorization framework for live TV streaming and FAST services to ensure regulatory parity with traditional cable operators.

The Telecom Regulatory Authority of India (TRAI) has recommended a mandatory government authorization framework for Application-based Linear Television Distribution (ALTD) services, including live TV streaming apps and Free Ad-Supported Streaming Television (FAST) platforms. The proposal, submitted to the Ministry of Information and Broadcasting, seeks to create regulatory parity between internet-based aggregators and traditional cable or DTH operators following concerns from industry stakeholders like the All India Digital Cable Federation regarding an uneven competitive environment.

Under the proposed rules, ALTD providers must obtain a 20-year authorization under the Telecommunications Act, 2023, by paying a one-time entry fee of Rs 1 lakh and a processing fee of Rs 10,000. TRAI also suggested a separate 10-year registration category for internet-native linear television channels with an annual fee of Rs 1 lakh per channel. The framework excludes social media live streams and single-brand applications owned by broadcasters.

To enforce these rules, smart TV manufacturers and operating system providers would be required to ensure only authorized applications are available on their devices and app stores, utilizing a centralized master repository. These providers must submit annual compliance reports to the government. Additionally, TRAI recommends integrating ALTD viewership into the national television audience measurement framework for channel ratings and designating application providers as the primary contact for consumer grievances.
