Judge Weighs Request to Block Arkansas News Outlets

U.S. District Judge Lee Rudofsky is weighing a request by Entergy Arkansas to block the Arkansas Democrat-Gazette and Arkansas Times from publishing confidential details of a data center agreement. The legal dispute follows a report by the Democrat-Gazette, based on Freedom of Information Act documents, revealing that Google will contribute $526 million toward a $1.6 billion solar facility designed to power a data center in West Memphis.

Entergy Arkansas argues that the documents were released in error and contain trade secrets, claiming the publication violated laws protecting confidential business information. In response, legal experts and free speech advocates argue that blocking the publication would constitute an unconstitutional prior restraint.

Judge Rudofsky stated he was "pretty skeptical" of the request. While he acknowledged that Entergy Arkansas has a strong case, he noted that the First Amendment gives him "significant pause" regarding the legality of the block.
