Andy Harris Threatens Journalist After Maryland Congressional Debate
Representative Andy Harris threatened to have a journalist's camera seized and prosecuted for recording him during a public press gaggle following a congressional debate.
Republican Representative Andy Harris threatened a journalist with criminal prosecution and demanded law enforcement seize her equipment following a congressional debate on October 14 in Cambridge, Maryland. After debating Democratic challenger Dan Schwartz at the Chesapeake Grove Intergenerational Center, Harris confronted Cat Murphy, a Capital News Service reporter and University of Maryland graduate student, during a post-debate press gaggle.
Harris accused Murphy of violating the Maryland Wiretapping and Electronic Surveillance Act, asserting that Maryland is a "two-party state" and that recording him without permission was a felony. The confrontation escalated when Murphy questioned Harris about U.S. military hostilities in Iran, leading Harris to demand that an officer be brought in to take her camera before he terminated the session and exited the room.
Legal experts, including Kevin Goldberg of the Freedom Forum and Joyce Smithey of the Smithey Law Group, stated that Harris misapplied the law. They noted that Maryland's consent laws protect private conversations and do not apply to public officials interacting with accredited press in a public forum where there is no reasonable expectation of privacy.
Dan Schwartz criticized the incident, stating Harris is "out of touch" and more interested in "picking fights" than answering voters. Murphy told CNN she has no intention of stopping her coverage of Harris. During the preceding debate, the candidates clashed over diesel prices and the war in Iran, though Harris diverged from the Trump administration by opposing a planned livestream of the execution of Nidal Hasan.
