Kalshi Legal Battle Over Sports Trading May Reach Supreme Court
Kalshi CEO Tarek Mansour says a dispute over whether sports trades are financial derivatives or gambling could be decided by the U.S. Supreme Court.
A legal conflict over the regulatory status of prediction markets may reach the highest court in the United States. Tarek Mansour, CEO of the prediction markets platform Kalshi, stated that the dispute centers on whether sports-related trades are financial derivatives regulated federally or gambling subject to state laws and taxes.
Kalshi argues that the Commodity Exchange Act grants the United States Commodity Futures Trading Commission authority to regulate these contracts. While federal appeals courts have issued split decisions, Kalshi recently won a case against New Jersey. The state has since requested a review by the Supreme Court of the United States.
The outcome will determine if the $40 billion company can operate as a broad trading platform competing with traditional exchanges or if it must submit to state-level gaming controls. Mansour maintains that the statute and structure of the law are clear regarding the authority of the federal regulator.
