Ontario Bans Social Assistance for Undocumented Migrants and Temporary Residents

The Government of Ontario immediately amended regulations for Ontario Works and the Ontario Disability Support Program to prohibit social assistance payments to individuals without legal immigration status. The new rules exclude people living in Canada illegally as well as those authorized only on a temporary basis, including holders of student, work, visitor, and tourist visas.

Premier Doug Ford initiated the policy change after media reports revealed an Ontario Social Benefits Tribunal ruling that granted payments to a man whose work permit had expired decades ago. Because existing legislation did not automatically exclude such individuals, the tribunal had allowed the claim. Minister Michael Parsa stated the amendments ensure taxpayer funds are directed toward people legally permitted to reside in Canada.

Critics, including the NDP and migrant community coordinators, argue the policy promotes racism and xenophobia. Conversely, legal experts from the Income Security Advocacy Centre suggest the impact may be minimal. They note that most undocumented persons were already ineligible and that the rules primarily target edge cases, such as failed refugees who cannot be deported.
