El Paso City Council Approves First Data Center Policy Framework

The El Paso City Council unanimously approved its first Data Center Policy Framework on July 20, 2026. The policy establishes guidelines for evaluating future hyperscale data center projects to protect utility ratepayers, natural resources, and local residents.

Developed over six months of research and public engagement, the framework requires future projects to obtain a Special Permit, which entails a City Plan Commission review, public notice, and a public hearing. To ensure accountability, the council eliminated local economic incentives and implemented stricter environmental standards for energy and water consumption. The policy also encourages the use of Community Benefit Agreements.

City Manager Dionne Mack stated that the framework establishes clear expectations for future projects while strengthening public participation and environmental protections. Although the framework provides a roadmap for future development, it does not apply to the Meta data center currently under construction in Northeast El Paso.
