Meta Challenges Ofcom Over Online Safety Act Classifications

Meta has launched a legal challenge against Ofcom, the UK media regulator, disputing the classification of WhatsApp and Instagram as Category 1 services under the Online Safety Act. This designation requires platforms to implement stricter measures against fraudulent advertising, increase transparency, and enhance the recording of illegal content. Meta argues that these specific duties are not designed for private messaging services.

This litigation follows a previous dispute where Meta challenged Ofcom's fee calculations based on global revenue. Other technology firms, including TikTok, X, Roblox, and Quora, are also pursuing legal actions regarding service categorizations and data requests. Meta maintains these disputes concern how the regulator has interpreted the law rather than the law itself.

Ofcom officials describe the current regulatory environment as highly litigious and have vowed to defend their decisions. Culture Secretary Lisa Nandy has criticized the slow pace of enforcement and indicated that the government will be more interventionist, updating laws regularly to keep pace with technological changes.
