EPA Exempts Islanded Power Plants from Acid Rain Program

The United States Environmental Protection Agency announced that power plants providing electricity exclusively to data centers and not to the public grid are not subject to the Clean Air Act’s Acid Rain Program. This interpretation applies specifically to islanded power generation facilities.

The agency stated that this guidance provides developers with greater flexibility and speed in building artificial intelligence infrastructure while reducing strain on regional electric grids. The decision follows a July 16 letter authored by EPA Assistant Administrator Aaron Szabo.

This action supports President Donald Trump’s Ratepayer Protection Pledge, a non-binding agreement expanded last week. The pledge requires participating companies to bear the costs of energy infrastructure for their own facilities rather than passing those costs to residential customers.
