Donald Trump Challenges Legal Precedent to Consolidate Agency Power

President Donald Trump is attempting to consolidate authority over independent U.S. regulatory agencies, challenging a 90-year-old legal precedent designed to protect these bodies from political influence. Through a February 18 executive order, Trump seeks to bring rulemaking under White House oversight via the Office of Information and Regulatory Policy.

As part of this strategy, Trump dismissed several Democratic commissioners from agencies including the National Labor Relations Board and the Consumer Product Safety Commission. This approach is based on the Unitary Executive Theory, which argues the president should have broad control over the federal bureaucracy. The effort is supported by Russell T. Vought, Director of the Office of Management and Budget, and the Department of Government Efficiency, which is tasked with cutting costs across the federal government.

While the conservative majority of the Supreme Court of the United States has allowed some firings to stand, the court carved out a specific exception for the Federal Reserve due to its unique structure. These actions have triggered more than two dozen lawsuits and warnings from market analysts that expanded presidential power could erode investor trust and market stability.
