Departing from the traditional dispassionate approach of past solicitors general, Sauer has leveraged the court's 6-3 conservative supermajority to advance President Donald Trump's legal agenda on executive authority and election law.

Sauer's influence is already visible in major rulings. In Louisiana v. Callais, the court weakened the 1965 Voting Rights Act, an outcome Sauer championed. He is also pressing the court to overturn a 1935 precedent in Trump v. Slaughter, which would allow the president to remove independent agency officials at will, further consolidating executive control over the federal bureaucracy.

While liberal justices have pushed back against Sauer's arguments, conservative justices have offered support, and Sauer has largely avoided the intense questioning previously directed at solicitors general. His appointment follows his earlier role as Trump's personal attorney, when he successfully secured the president's immunity from criminal prosecution in 2024.

The strategy marks a significant shift in how the executive branch approaches the Supreme Court, trading institutional deference for ideological combat. If successful, the ongoing cases could fundamentally alter the balance of power between the presidency and independent federal agencies, while reshaping the legal framework governing American elections.
