A leaked draft resolution reveals that the Board of Peace, a UN-sanctioned body chaired by Donald Trump, is seeking broad legal immunity for its members, administrative staff, international forces, and contractors operating in the Gaza Strip. The document, titled Resolution No 2026/3, would shield these personnel from arrest, detention, and legal proceedings within Gazan courts. It further proposes allowing the board to utilize Palestinian public property and facilities without compensation and establish an internal mechanism to adjudicate claims for injury or property damage.
Authorized by the UN Security Council to oversee Gaza's administration until December 31, 2027, the board's executive membership includes Donald Trump, Jared Kushner, Steve Witkoff, Susie Wiles, and Marco Rubio. While the draft suggests Trump could waive immunity for members, a Board of Peace official has denied the existence of such a framework, calling claims of intended impunity misleading.
Legal experts warn the move could create a parallel legal system and eliminate external oversight, potentially leading to the illegal confiscation of property. Despite the UN mandate, the U.S. Senate has not ratified a treaty recognizing the board as a legitimate international organization. High Representative Nickolay Mladenov is expected to sign the resolution following discussions with Palestinian administrators in Cairo.
