Trump Administration Clashes With Federal Judiciary Over Court Orders

The Donald Trump administration is facing a breakdown in trust with federal courts following widespread noncompliance with judicial orders and attacks on judges.

The second administration of Donald Trump is experiencing a widening breakdown in trust with the federal judiciary, marked by repeated disputes over compliance with court orders and personal attacks on judges. Federal courts have documented numerous instances of legalistic noncompliance, including the violation of hundreds of immigration-related orders in New Jersey and Minnesota, as well as failures to adhere to discovery orders in California.

To bypass judicial blocks on policies such as tariffs and spending freezes, the administration has frequently contested the validity of oral directives and employed alternative legal rationales. In Minnesota, Chief Judge Patrick J. Schiltz found the government violated 210 orders in immigration cases. In response to such judicial criticism, the United States Department of Justice has filed misconduct complaints against nearly every active district judge in Minnesota.

Vice President JD Vance argued that judges are not permitted to control the legitimate power of the executive. White House spokeswoman Lauren Bis defended the administration, claiming it follows all court orders and accusing lower courts of using lawless injunctions to obstruct the president's agenda. However, judges from both political parties have noted an erosion of the presumption of regularity traditionally afforded to the executive branch, expressing skepticism toward Justice Department representations.
