Judge Blocks Trump Mail-In Ballot Rules Amid State Lawsuits

U.S. District Judge Indira Talwani issued a 14-day temporary restraining order on August 28, blocking the United States Postal Service from implementing new regulations that restrict mail-in voting for the 2026 midterm elections. The rules, stemming from a March executive order by President Donald Trump, require states to submit voter lists to a federal portal and use specific envelope designs with unique barcodes. The USPS threatened to refuse delivery to non-compliant states or voters not included in the federal database.

The legal battle followed a volatile sequence. The Supreme Court of the United States previously ruled 6-3 that earlier challenges to the order were premature because the formal rules had not yet been published. Following that ruling, Judge Talwani initially lifted her nationwide injunction. However, once the USPS finalized and published the rules on August 21, a coalition of 24 Democratic-led states and the District of Columbia filed new lawsuits in Massachusetts. Judge Talwani subsequently re-blocked the rules, stating that states face "irreparable harm" and that compliance is practically impossible with the November 3 election approaching.

President Donald Trump defended the measures as essential for election security and preventing noncitizen voting, while critics and state officials argue the rules are an unconstitutional federal overreach into state-run elections. The USPS has since appealed the injunction. A hearing to determine if a longer-term preliminary injunction is warranted is scheduled for September 3.
