Judge Certifies Class Action Lawsuit Against Transgender Military Ban

U.S. District Judge Ana Reyes certified a class action lawsuit against the Trump administration's ban on transgender military service, scheduling a trial for January 4.

U.S. District Judge Ana Reyes certified a class of transgender service members and prospective troops on June 30, 2026, in the case of Talbott v. USA. The ruling expands the legal challenge against the Trump administration's ban on transgender military service, ensuring that future court decisions may benefit a broad group of affected individuals rather than only the named plaintiffs.

The class certification follows a June 1 decision by the U.S. Court of Appeals for the D.C. Circuit, which declared the Pentagon's ban unlawful but only provided protections to specific plaintiffs in that case. The current ruling potentially extends those protections to all transgender service members. The legal conflict stems from a January 27, 2025, executive order signed by President Donald Trump, which asserted that gender dysphoria is incompatible with military service standards.

While granting the motion, Judge Reyes expressed skepticism toward the plaintiffs' original broad class definition and admonished their legal team for wasting a year of litigation time. The Trump administration, with the policy executed by Defense Secretary Pete Hegseth, continues to defend the ban in court. The National Center for LGBTQ+ Rights, representing the plaintiffs, argues the policy is rooted in animus rather than military necessity. A trial is scheduled for January 4.
