This condition creates a legislative deadlock as Section 702, which allows U.S. intelligence agencies to surveil foreign nationals without a warrant, officially expired on Friday.
Senate Majority Leader John Thune intends to pass the FISA extension without the Save America Act, arguing that the lapse of the surveillance program poses a risk to national security. Thune previously indicated that the Save America Act remained stalled following a spirited debate, leading some Republican members to threaten to withhold their votes for FISA unless the two measures are linked.
Despite the expiration of the law, a March court order allows the federal government to maintain its surveillance powers for one additional year. This legal bridge prevents an immediate loss of intelligence collection capabilities while lawmakers remain divided over the legislative terms ahead of their recess.
