Supreme Court Revives Trump Voter Citizenship Database

The Supreme Court issued a 6-3 emergency order on September 25, 2026, allowing the Donald Trump administration to resume using the Systematic Alien Verification for Entitlements (SAVE) database to verify the citizenship of registered voters. The ruling overturned a June decision by U.S. District Judge Sparkle Sooknanan, who had blocked the modified system for violating federal privacy laws, including the Social Security Act and the Privacy Act.

Originally designed for public benefit eligibility, the SAVE system was expanded via a March 2025 executive order to merge immigration status with Social Security records, passports, and driver's licenses. This overhaul, assisted by the Department of Government Efficiency, enables bulk queries to identify noncitizens on state voter rolls. The majority opinion stated the federal government has an obligation to respond to state requests for citizenship verification.

Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented, arguing that the risk of disenfranchising lawful voters outweighs the government's interests. Critics, including the League of Women Voters, cited inaccuracies in the system, noting that in Texas, 20% of voters flagged as potential noncitizens were later found to be citizens.

While the ruling is a victory for the administration, the immediate impact on the November 3 midterms will be limited. The National Voter Registration Act prohibits systematic voter roll purges within 90 days of an election. In a separate ruling, the Supreme Court blocked a different administration effort to allow the U.S. Postal Service to regulate mail-in voting.
