Texas Governor Greg Abbott Fights Minnesota Extradition Request

Texas Governor Greg Abbott has asked a federal judge to reject Minnesota's attempt to force the extradition of Christian Castro, an Immigration and Customs Enforcement officer currently held in Cameron County Jail. Castro faces charges in Minnesota for second-degree assault and falsely reporting a crime following an alleged shooting of a Venezuelan man during a January 14 immigration crackdown in Minneapolis.

Abbott argues that Castro may not be a fugitive because the federal government reassigned him to Texas rather than him fleeing justice. He has tasked interim Texas Secretary of State Robert Howden to investigate the circumstances before a final decision is made. In response to Minnesota's legal pressure, Abbott cited a welfare fraud scandal in Minnesota as a counter-demand, stating it is time for the state to repay the United States for fraud committed under federal programs.

Minnesota Attorney General Keith Ellison filed a federal lawsuit on August 18 to compel the extradition, calling the refusal unconstitutional. Minnesota is also seeking a court order to keep Castro in custody beyond the 90-day Texas limit. Abbott countered that the 90-day period limits pre-warrant detention but does not impose a deadline on the governor to approve or deny the request.
