Judge Vacates Trump Order Halting Wind Energy Projects

A federal judge struck down President Donald Trump's executive order freezing wind energy permits, ruling the moratorium was arbitrary, capricious, and contrary to law.

U.S. District Judge Patti B. Saris vacated a January 20 executive order issued by President Donald Trump that halted federal approvals, leases, and permits for all onshore and offshore wind energy projects. In a ruling issued December 8, 2025, Judge Saris declared the "Wind Order" arbitrary, capricious, and contrary to law, stating the administration failed to provide a reasoned explanation for the policy shift as required by the Administrative Procedure Act.

The legal challenge was brought by a coalition of 17 Democratic-led states, the District of Columbia, and the Alliance for Clean Energy New York. Led by New York Attorney General Letitia James, the plaintiffs argued the freeze created an existential threat to the industry, jeopardizing billions in investments and thousands of green jobs. The ruling removes barriers for approximately 500 stalled projects, including the Empire Wind 1 and Sunrise Wind farms.

White House spokeswoman Taylor Rogers defended the order as a necessary move to end "preferential treatment" for renewables and protect national security. President Trump supported the measure at a rally in Pennsylvania, claiming wind farms primarily benefit their owners and that "China has very few wind farms." However, the ruling was praised by state officials, including Massachusetts Attorney General Andrea Campbell and California Attorney General Rob Bonta, as a victory for clean energy.

In a separate case on December 15, Judge Stephanie Gallagher denied a preliminary injunction request from US Wind regarding a project off Delmarva, ruling that the company's decision to pause investment was a business choice based on perceived political headwinds rather than a final government action.
