Brazil Sues Meta Over Alleged Election Bias and Account Bans

Brazil's Federal Public Ministry and Superior Electoral Court are suing Meta over allegations of algorithmic bias and arbitrary account bans ahead of a presidential runoff.

The Brazilian government and electoral authorities have launched multiple legal actions against Meta Platforms and its local unit, Facebook Serviços Online do Brasil, alleging the company manipulated content reach and banned accounts to influence the October 25 presidential runoff.

Brazil's Federal Public Ministry filed a lawsuit in Porto Alegre seeking to stop arbitrary account bans and reach cuts targeting activists and independent media. Prosecutors allege that automated systems disproportionately blocked over 1,000 accounts in September and October, specifically targeting critics of Senator Flávio Bolsonaro. The lawsuit seeks the restoration of content and daily fines of R$500,000 per account for non-compliance.

Simultaneously, the Superior Electoral Court is investigating claims of algorithmic bias. President Luiz Inácio Lula da Silva's campaign filed a lawsuit to disqualify Bolsonaro's ticket, citing the misuse of mass media and AI tools. Justice Marco Aurelio Bellizze ordered Meta to ensure equal treatment of both campaigns, while Court President Kassio Nunes Marques demanded a report on a pro-Lula WhatsApp channel following complaints from the Bolsonaro campaign.

Meta has denied any political bias, stating that content reach depends on audience engagement. While the company acknowledged technical incidents that hindered the boosting of content related to President Lula, it maintains that claims of interference are baseless. The dispute has drawn international scrutiny, with U.S. Senator Bernie Sanders and Democratic House members calling for an independent audit of the platforms.
