Trump Directs $400M TikTok Child Privacy Settlement to D.C. Monuments

The Trump administration is nearing a $400 million settlement with TikTok to resolve a 2024 Justice Department lawsuit alleging the platform violated the Children's Online Privacy Protection Act by collecting personal data from millions of children under 13 without parental consent. Rather than compensating the alleged victims, the administration plans to direct the funds toward Donald Trump's Washington, D.C. "beautification" agenda, potentially through the Department of the Interior or Department of Commerce.
Proposed projects include a 250-foot triumphal arch near Arlington National Cemetery and repairs to the Lincoln Memorial Reflecting Pool. The settlement requires TikTok board approval and does not include an admission of wrongdoing. The arrangement contradicts standard Justice Department practice and a policy reinstated by Attorney General Pam Bondi requiring settlements to prioritize victim compensation.
The settlement follows Trump's direct role in brokering TikTok's continued U.S. operations. ByteDance, TikTok's Chinese parent company and co-defendant in the lawsuit, finalized a deal in January 2026 to establish a majority American-owned joint venture involving Oracle and Silver Lake, averting a national ban on the app used by over 200 million Americans. That personal involvement raises ethical concerns about the settlement's structure.
The beautification push coincides with Trump's proposed 2027 budget, which creates a $10 billion "Presidential Capital Stewardship Program" while cutting the National Park Service's operating budget by over $1 billion and reducing staffing by 3,000 employees. Interior Secretary Doug Burgum testified that the stewardship funds would address deferred maintenance. The White House and Justice Department declined to comment, and TikTok did not respond to requests for comment.
