Kavanaugh and Jackson Clash Over Trump Administration Emergency Orders

Supreme Court Justices Ketanji Brown Jackson and Brett Kavanaugh clashed during an annual lecture in memory of former judge Thomas A. Flannery at a Washington federal courtroom. The debate focused on the court's increasing use of the emergency docket to allow President Donald Trump to implement key agenda policies while legal challenges remain pending.

Justice Jackson criticized the practice as a warped legal process, arguing that the court is predicting outcomes before arguments are fully developed and allowing new policies to take effect before challenges are decided. She asserted that this uptick in the court's willingness to intervene does a disservice to the country.

Justice Kavanaugh defended the emergency orders, stating that the court is simply performing its job by addressing filed applications. He argued that administrations frequently push regulatory boundaries as passing legislation through Congress becomes more difficult, and noted that similar emergency orders were used to support policies during the Biden administration.

The dispute follows a series of 2025 emergency rulings favoring the Trump administration regarding passport sex designations, foreign aid funding, and the cancellation of DEI-related research grants. The event was attended by several federal judges, including James Boasberg and Royce Lamberth, both of whom have had high-profile legal clashes with the Trump administration.
