US Court Denies Greenspan Discovery Request Involving Nigeria's President
The US District Court for the District of Columbia rejected Aaron Greenspan's bid to obtain evidence from Nigerian President Bola Tinubu in a FOIA lawsuit.
The United States District Court for the District of Columbia denied a motion by Aaron Greenspan to obtain limited discovery from Nigerian President Bola Tinubu and the DCI Group. The ruling, issued on October 30, 2026, rejected Greenspan's attempt to gather evidence regarding alleged cyberattacks on his website, with the court determining these claims were not sufficiently relevant to the underlying Freedom of Information Act (FOIA) lawsuit.
The litigation involves the Federal Bureau of Investigation and the Drug Enforcement Administration. In addition to blocking the discovery request, the court denied Greenspan's motion for summary judgment and his request for judicial notice. The court also rejected an application by nonparty Karl Von Batten to submit an amicus curiae brief.
Attorneys Christopher W. Carmichael and Oluwole Afolabi stated the decision reinforces the need to keep the litigation focused on the specific legal questions of the FOIA proceedings rather than unrelated discovery. While these rulings establish procedural boundaries, the substantive FOIA issues against the federal agencies remain unresolved and the litigation continues.
