Representative Jamie Raskin introduced legislation HR 8275 to establish a 17-member bipartisan Commission on Presidential Capacity. The proposed body would serve as the professional entity authorized under Section 4 of the 25th Amendment to help determine if a president is unable to fulfill their duties, providing a mechanism to sideline a leader who refuses to step aside.

The bill follows calls from more than 80 Democratic members of Congress to invoke the 25th Amendment against President Donald Trump. These calls stem from reports of erratic behavior, including public threats to bomb Iran. Seven psychiatrists further supported these concerns in a letter to congressional leadership, warning that the president is experiencing profound psychological distress.

Under the proposed framework, the commission would work with the vice president to assess presidential capacity. A president could appeal such a determination to Congress, where a two-thirds vote in both chambers would be required for suspension. Although the bill has 85 Democratic co-sponsors, its passage is considered unlikely in the current Congress, potentially shifting the political focus toward the November elections.
